Allgemeine Geschäftsbedingungen (AGB) – Fiberseats

§1 Geltungsbereich

  1. Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Verträge, die über den Online-Shop von Fiberseats zwischen uns und unseren Kunden geschlossen werden. 
  2. Verbraucher im Sinne dieser AGB ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbstständigen beruflichen Tätigkeit zugerechnet werden können. 
  3. Abweichende Bedingungen des Kunden werden nicht anerkannt, es sei denn, wir stimmen ihrer Geltung ausdrücklich zu.


§2 Vertragspartner

Der Kaufvertrag kommt zustande mit:

§3 Vertragsschluss

  1. Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot dar, sondern eine unverbindliche Aufforderung zur Bestellung. 
  2. Mit Abschluss des Bestellvorgangs gibt der Kunde ein verbindliches Angebot ab. 
  3. Der Vertrag kommt erst durch unsere ausdrückliche Auftragsbestätigung oder durch Beginn der Produktion zustande.


§4 Preise und Zahlungsbedingungen

  1. Alle Preise verstehen sich in Euro inklusive gesetzlicher Mehrwertsteuer. 
  2. Versandkosten werden gesondert ausgewiesen.
  3. Die Zahlung erfolgt über die im Shop angebotenen Zahlungsmethoden. 
  4. Die Produktion individuell gefertigter Produkte beginnt erst nach Zahlungseingang.

§5 Lieferung und Versand

  1. Die Lieferung erfolgt an die vom Kunden angegebene Adresse.
  2. Lieferzeiten werden im jeweiligen Produkt angegeben. 
  3. Bei individuell gefertigten Produkten können sich Lieferzeiten aufgrund der Produktion verlängern. 
  4. Teillieferungen sind zulässig, soweit sie dem Kunden zumutbar sind.


§6 Eigentumsvorbehalt

Die Ware bleibt bis zur vollständigen Bezahlung unser Eigentum.

§7 Individuelle Anfertigung

  1. Fiberseats bietet individuell konfigurierte und personalisierte Produkte an. 
  2. Diese Produkte werden nach Kundenspezifikation gefertigt. 
  3. Der Kunde ist verpflichtet, seine Angaben sorgfältig zu prüfen, da diese Grundlage der Produktion sind.


§8 Widerrufsrecht

  1. Verbrauchern steht grundsätzlich ein Widerrufsrecht von 14 Tagen zu.
    1. Ausschluss des Widerrufsrechts:
      Das Widerrufsrecht besteht nicht bei Verträgen zur Lieferung von Waren, 
      • die nicht vorgefertigt sind und 
      • für deren Herstellung eine individuelle Auswahl oder Bestimmung durch den Kunden maßgeblich ist
  2. Dies betrifft insbesondere alle individuell konfigurierten Fiberseats-Produkte.


§9 Gewährleistung

  1. Es gelten die gesetzlichen Gewährleistungsrechte. 
  2. Bei Mängeln hat der Kunde Anspruch auf Nacherfüllung (Nachbesserung oder Ersatzlieferung). 
  3. Weitergehende Ansprüche richten sich nach den gesetzlichen Vorschriften.


§10 Haftung

  1. Wir haften uneingeschränkt bei Vorsatz und grober Fahrlässigkeit. 
  2. Bei leichter Fahrlässigkeit haften wir nur bei Verletzung wesentlicher Vertragspflichten (Kardinalpflichten). 
  3. Die Haftung ist auf den vorhersehbaren, vertragstypischen Schaden begrenzt. 
  4. Die Haftung für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit bleibt unberührt.


§11 Produktspezifikationen und Abweichungen

  1. Geringfügige Abweichungen in Farbe, Material oder Verarbeitung können aufgrund der individuellen Fertigung auftreten. 
  2. Diese stellen keinen Mangel dar, sofern sie branchenüblich und zumutbar sind.


§12 Nutzung und Belastung

  1. Unsere Produkte sind gemäß den vorgesehenen Einsatzbereichen zu verwenden. 
  2. Für Schäden durch unsachgemäße Nutzung übernehmen wir keine Haftung.


§13 Kulanzregelung

Fiberseats kann im Einzelfall freiwillige Lösungen anbieten. 
Ein Anspruch hierauf besteht nicht.

§14 Streitbeilegung

Die Europäische Kommission stellt eine Plattform zur Online-Streitbeilegung (OS) bereit. 
Wir sind nicht verpflichtet und nicht bereit, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.

§15 Anwendbares Recht

Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts.

§16 Schlussbestimmungen

Sollten einzelne Bestimmungen unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

§1 Scope of Application

  1. These Terms and Conditions govern all agreements concluded between Fiberseats and its discerning clientele via our online boutique.
  2. A “consumer” within the meaning of these Terms is any natural person engaging in a transaction for purposes predominantly outside their commercial or professional activity.
  3. Any divergent terms from the customer shall only apply if expressly acknowledged by Fiberseats in writing.


§2 Contracting Party

§3 Conclusion of Contract

  1. Product presentations in our online boutique constitute an invitation to order, not a binding offer.
  2. By completing the order process, the customer places a binding proposal.
  3. A contract is formalized only through our explicit order confirmation or the commencement of production—marking the transformation of your vision into a bespoke Fiberseats creation.


§4 Prices and Payment Terms

  1. All prices are stated in Euro, including statutory VAT.
  2. Shipping costs are indicated separately.
  3. Payment may be made via the methods offered in our online boutique.
  4. Production of your individually crafted Fiberseats piece begins only upon receipt of full payment—a reflection of the care and exclusivity inherent in each creation.


§5 Delivery and Shipping

  1. Delivery is made to the address specified by the customer.
  2. Delivery times are indicated on the product page, tailored to the unique requirements of each piece.
  3. For bespoke products, delivery may extend due to the meticulous craftsmanship involved.
  4. Partial deliveries are permitted if reasonable and convenient for the customer.


§6 Retention of Title

All products remain the property of Fiberseats until full payment has been received, honoring the value and uniqueness of each creation.

§7 Bespoke Production

  1. Fiberseats specializes in individually configured and personalized creations.
  2. Every product is handcrafted in accordance with your specifications, blending premium materials and unparalleled precision.
  3. Customers bear the responsibility to ensure that all submitted details are accurate, as they form the blueprint for production.


§8 Right of Withdrawal

  1. Consumers are generally entitled to a statutory 14-day right of withdrawal.

    • Exclusion of Withdrawal Rights:

      The right of withdrawal does not apply to contracts for the supply of goods that are:

      – Crafted individually and not pre-fabricated,

      – Determined by your personal choices or specifications, or

      – Uniquely tailored to your personal needs.

  2. This exclusion applies in particular to all individually configured Fiberseats creations. Every piece is as unique as its owner.


§9 Warranty

  1. Statutory warranty rights apply.
  2. In case of defects, customers are entitled to remedy or replacement.
  3. Further claims are governed by applicable law.


At Fiberseats, quality is uncompromising, but perfection meets reality—any issues are handled with the utmost care.

§10 Liability

  1. Fiberseats assumes unlimited liability in cases of intent or gross negligence.
  2. For minor negligence, liability is limited to essential contractual obligations.
  3. Liability is capped at foreseeable, typical contractual damage.
  4. Liability for harm to life, body, or health remains unaffected.


§11 Product Specifications and Variations

  1. Slight variations in color, material, or finish may occur due to the handcrafted nature of each creation.
  2. Such deviations are not defects, provided they are customary and reasonable within the industry. Every variation is part of the charm and individuality of your bespoke piece.


§12 Use and Care

  1. Our creations are designed for their intended use.
  2. Fiberseats assumes no liability for damage caused by misuse or overloading. Proper care preserves the longevity and beauty of your piece.


§13 Goodwill Policy

On occasion, Fiberseats may offer individualized solutions beyond legal obligations.

While we take pride in our flexibility, these are gestures of goodwill rather than contractual rights.

§14 Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR).

Fiberseats is not obligated, nor willing, to participate in dispute resolution proceedings before a consumer arbitration board.

§15 Applicable Law

These Terms shall be governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

§16 Final Provisions

Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain intact. Each clause reflects our commitment to excellence and the enduring value of every Fiberseats creation.
